DISPUTES  

Any disputes arising under or relating to the terms of these terms and conditions that cannot be resolved by the parties themselves shall be submitted for medication in Cumberland County, North Carolina administered by and according to the rules of the Commercial Medication of the American Arbitration Association. Each party shall bear their own costs in the medication, including attorney’s fees and one half the cost of the mediator.  

Any dispute that remains unresolved after the mediation will be resolved by final and binding arbitration in Cumberland County, North Carolina before a single arbitrator administered by and according to the rules of the Commercial Medication of the American Arbitration Association. Each party shall bear their own costs in the arbitration, including attorney’s fees and one half the cost of the arbitrator.  

The arbitrator shall have the authority to award such damages as are not prohibited by this agreement and may, in addition and in proper case, declare rights and order specific performance, but only in accordance with these terms and conditions.
